10 MALONE: Are you downtown?
11 BRISTOL: Yeah. I'm at work.
12 MALONE: Uh, can you meet me?
13 BRISTOL: Uh, I've got somebody comin' in, in
14 ten minutes. What do you need?
15 MALONE: No. I uh, can we talk?
16 BRISTOL: Here? On the phone now…
17 MALONE: No, no. Yeah.
18 BRISTOL: …or somewhere else?
19 MALONE: No. On the phone right now is fine.
20 BRISTOL: Um, actually right now I'm okay.
21 Yeah.
22 MALONE: Okay. Uh, I just got done with
23 talkin' to Zucchet.
24 BRISTOL: Uh huh.
25 MALONE: Uh, I got a call this morning from
26 his guy named Anthony, and I think
27 his name is Wagoner.
28 BRISTOL: Okay.
Page 2
01 MALONE: Well, he called and spoke to, I
02 don't know what lieutenant, and a
03 sergeant, and they've got a meeting
04 scheduled for Friday at three
05 o'clock. So uh, as soon I got that
06 call, I had to rush down here to
07 meet with Zucchet personally.
08 BRISTOL: Okay, so…
09 MALONE: So I met with…
10 BRISTOL: He's telling you he has a meeting
11 set with somebody?
12 MALONE: Yeah. He said he's, they've got a
13 meeting scheduled at three o'clock
14 with the lieutenant and the s-, the
15 sergeant of vice.
16 BRISTOL: Oh, okay.
17 MALONE: Which I, you know, he didn't give me
18 any names. I mean, I don't, I don't
19 know who's who. And uh, I, I thought
20 you were a sergeant, so I thought
21 maybe it was you. And I, I didn't
22 know if you were a sergeant or not,
23 but…
24 BRISTOL: No. I'm a detective.
25 MALONE: Okay. In any case, um, I said well
26 listen, I said, uh, first and
27 foremost man, one thing I will never
28 do is get you in any trouble. So,
Page 3
01 you know, that's one thing, you
02 don't have to worry. 'Cause with
03 Ralph Inzunza and Charles, I can, I
04 can speak a hell of a lot freer than
05 I can with Mike, 'cause I don't know
06 Zucchet all that well.
07 BRISTOL: Right.
08 MALONE: I know Inzunza real well.
09 BRISTOL: Uh huh.
10 MALONE: And so um, they, you know, the three
11 of us decided that it would be
12 Zucchet that n-, did all this. You
13 know, because he's got the one
14 that's in his district.
15 BRISTOL: Right.
16 MALONE: Then it, it looked a lot better for
17 Zucchet to say hey, I want, so he,
18 all he says he's gonna do on Friday
19 is just tell him about the distance,
20 he wants to go to fifteen hundred
21 feet, he wants to do more parking.
22 Uh, things to that effect. Um, and,
23 and he'll pr-, he said he, you know,
24 your name of course would never ever
25 be mentioned.
26 BRISTOL: (UI).
27 MALONE: And uh, he said he, you, you know,
28 depending on how the meeting goes,
Page 4
01 may get a feel of, "Hey listen, what
02 happened three or four years ago? Is
03 that no touching working?" You
04 know, s-, something along those
05 lines. And I said, "Well don't say
06 anything until I get back to you."
07 So then I gave him, y-, 'cause he
08 keeps thinkin', he goes, "Well
09 Lance," he goes, "I'm, I'm happy to
10 call, you know, you know, your guy.
11 But I don't know if, you know, I
12 mean, how is he gonna get down here
13 and, and testify? I mean, I mean,
14 doesn't, you know, he's gotta go
15 through captains and lieutenants and
16 all the," he goes, you know, "We're
17 normally used to dealing with the
18 captains and lieutenants."
19 BRISTOL: Right.
20 MALONE: I said, I said "Listen, just do me a
21 favor. Just call him, and just see
22 what he says." I said, you know…
23 BRISTOL: And he has not.
24 MALONE: No, no. I just talked to him this,
25 this morning though.
26 BRISTOL: Mm hm.
27 MALONE: He, he said he will talk to you by
28 tomorrow. He said, you know, he's
Page 5
01 got, they've got some Charger
02 meeting today. So he says that'll
03 be, take him all day. But he says
04 he'll call you first thing tomorrow.
05 BRISTOL: Okay. He's gonna be throwin' a
06 serious wrench in things if he
07 starts goin' to somebody else who's
08 obviously not been uh…
09 MALONE: Yeah.
10 BRISTOL: …on the same page as everybody else
11 has this whole time.
12 MALONE: Well, and that's why I said that,
13 you know, if, if, if he did, if he
14 does do this, then (UI), just talk
15 about, you know, 'cause he's
16 already, if he says he's got this
17 meeting scheduled, fine. Then just
18 talk about the things that you wanna
19 add to. Don't talk about anything
20 else other than you wanna, you wanna
21 go to a thousand, to fifteen hundred
22 feet.
23 BRISTOL: Okay, realize that uh, after this is
24 all over, if we go the route that
25 we've, this thing has been
26 preplanned by you guys. And it goes
27 before the thing, and I actually end
28 up going over and talking about what
Page 6
01 you want, that I'm pretty much hosed
02 at that point. Especially if they're
03 gonna go to somebody above me. My
04 job here'll be uh, I think I'll be
05 workin' for you guys.
06 MALONE: Well, let's uh, alright well, I'm,
07 I'm tryin' just to cancel the
08 meeting. So, you know, and maybe,
09 maybe if you talk to him, he'll say
10 yes.
11 BRISTOL: Well, if he gives me a call, yeah.
12 And I'll keep my ears open. I have
13 heard nothing here about that. But
14 that, it's obvious I'm not, may not
15 hear about everything, but uh…
16 MALONE: Right.
17 BRISTOL: So that's Friday at three.
18 MALONE: That's what he's telling me. Um, but
19 uh, yeah, and just keep me abreast
20 of everything that you hear, or if
21 there's anything else goin' on so
22 that I can, I can try and, and do my
23 part and, and, but you know, I don't
24 know why the guy won't listen and
25 just say oh, okay, that's fine. Let
26 me just call him. I mean, you know,
27 listen, you're a detective.
28 BRISTOL: Right.
Page 7
01 -
02 MALONE: You know, you can make the same
03 calls as anyone else. You know,
04 what's the problem? Why does he
05 feel like he's gotta, he goes, "Well
06 Lance, that's, you know, not normal,
07 you know, council procedure. We
08 usually have to go through a captain
09 or lieutenant."
10 BRISTOL: Mm.
11 MALONE: And I said well, I said, "Listen."
12 I said, "Just give R-, give Russ a
13 call and just talk to him. See what
14 he says. If he says yeah, that's
15 the way to go, then that's the way
16 to go."
17 BRISTOL: Alright.
18 MALONE: You know, or if he can do it, and
19 say no, no, you, we, you can go
20 through me. Uh, you know, you're
21 makin' the call. He called this
22 number, I picked up the phone, I'm
23 talkin' to you, fine. No, no, it,
24 it, it's a no brainer.
25 BRISTOL: Yeah. Well, let me keep my ears open
26 and see if I hear anything about it.
27 If anything comes up, or I think of
28 anything, I'll give you a holler
Page 8
01 back.
02 MALONE: And, and listen man. If it gets, if
03 it gets too weird or anything, then
04 we just blow the whole thing. I'll
05 just tell them, listen, just, we,
06 we, we, we'll, we'll deal with it
07 another time.
08 BRISTOL: Okay. I'll give you a call if I hear
09 anything.
10 MALONE: Alright, buddy.
11 BRISTOL: Alright, Lance.
12 MALONE: Thanks, bro.
13 BRISTOL: Bye.

15 (END OF CALL)
16 BRISTOL: That was a call received at my desk
17 uh, probably about uh, ten fifty-

19 is now ten fifty-eight hours. Call
20 is concluded. This is Detective
